ProudSpot Terms of Service
Last updated November 1, 2026 Draft — not yet in effect
ProudSpot is a living digital showcase service operated by Liberty Smart Consulting Group LLC, Hinesville, Georgia ("ProudSpot," "we"). You use your ProudSpot dashboard to build a showcase page for a person, milestone or occasion, add moments over time, and share it with one link and QR code. These terms apply to every ProudSpot account, draft, purchase, gift and published page.
1. Who can use ProudSpot
1.1 You must be at least 18 years old to create an account, buy, give or redeem a ProudSpot, and to build or approve a page.
1.2 Pages that feature a minor are accepted only when the featured minor is 13 or older. The account holder must be that minor's parent or legal guardian, or must have the parent's or guardian's permission to create and publish the page. ProudSpot does not create pages for children under 13.
1.3 Pages about another adult: you must have that person's permission to publish their name, photos and story, or a good-faith reason to believe they would welcome it (for example, a surprise birthday page built by family). If the featured adult asks for the page to be changed or taken down, we may do so.
1.4 Memorial and tribute pages: you must be a family member or close friend of the person being remembered, or have the family's permission. If the family asks us to change or remove a memorial page, we may do so even if you built it.
2. Your account and dashboard
You sign in with a one-time link or code sent to your email. Keep your email account secure; anyone who controls it can manage your pages. You are responsible for activity in your account. Tell us at [email protected] if you think someone else has accessed it.
3. What you get
3.1 Each page starts with a one-time $129 purchase or a gift code. After that, you can save and edit your page privately as a draft until you publish it.
3.2 Each page costs $129 (one-time), paid by purchase or by redeeming a gift code. It includes one showcase page with one permanent link; a printable QR keepsake card; up to 20 media files (no more than 25 MB per file and 40 MB total); ongoing milestone updates while hosting is active; and one year of hosting starting on the date the page is first published.
3.3 Supported formats are JPG, PNG and WebP photos, MP4 video, and MP3 and M4A audio. HEIC/HEIF and MOV files must be converted before upload.
3.4 Custom design work, extra storage and phone support are not included unless we agree in writing.
4. Building, review and publication
4.1 You write, choose and arrange your page's content and approve it before it is submitted. You are responsible for its accuracy and for having permission to use it.
4.2 Before a page or update goes live, ProudSpot checks it. Text and photos go through automated safety and rights screening; video, audio and anything flagged go to a person for review. We may approve, hold, ask you to change, or reject content. Review is a safety check, not an endorsement, and it does not shift responsibility for the content to us.
4.3 We don't guarantee how long review takes. If your page is for a specific date, start early.
4.4 You choose who can see the page: Public or Unlisted (anyone with the link) or Private (current password required). We do not submit individual pages to search engines, but anyone who can view a page can save or share what they see.
5. Updates, surprise reveals and version history
5.1 While hosting is active you can add milestones and make updates. Each update is checked before it goes live; the currently approved version stays up in the meantime, and the link and QR code don't change.
5.2 You can schedule a page to stay locked until a date and time you choose (a "surprise countdown"). Until then, viewers see a countdown instead of the page.
5.3 We keep prior approved versions so a version can be recovered on request. We may limit how many versions are kept.
5.4 We may show you simple aggregate view counts. We don't track individual visitors.
6. Gifts
6.1 Anyone 18 or older can buy a ProudSpot as a gift. After payment, the buyer receives a one-time gift code to give to the recipient with an optional note.
6.2 The person who redeems a gift code becomes the owner of that page and its account controls. The buyer has no access to or control over the recipient's page unless the recipient shares it.
6.3 A gift code can be redeemed once, has no cash value and expires one year after purchase if it hasn't been redeemed. A lost code can be replaced if it hasn't been redeemed.
6.4 A buyer may request a full refund of an unredeemed gift code within 30 days of purchase. Once a code is redeemed, the refund rules in section 10 apply to the recipient's page.
6.5 If you want to build the page yourself as a surprise, buy and build it from your own account instead of sending a code. You then own it and are responsible for it under section 1.
7. Optional AI features
7.1 Help Me Write is optional. If you use it, your prompts are sent to a third-party AI service to generate suggested text. Suggestions are screened, limited in number, and never published unless you choose them and they pass review. AI suggestions may be inaccurate; check them before using them. Text you accept becomes your content under section 8.
7.2 The ProudSpot website assistant answers general questions using AI. It can make mistakes, can't see your account, orders or pages, and can't make commitments or exceptions for us. Its answers don't change these terms. Don't enter payment details, passwords, codes or a minor's personal information into the assistant.
8. Your content and our license
8.1 You keep ownership of everything you upload or write. You give ProudSpot a limited license to store, process, screen, resize, display and deliver it only as needed to build, review, host, back up, support and share your page.
8.2 You confirm you have the rights and permissions to use all photos, video, music, audio, names and text on your page, including content showing other people.
8.3 A small "Made with ProudSpot" credit may appear on your page. You can turn it off in your dashboard.
8.4 We won't use your page or media in our marketing without your separate, written permission.
9. Content rules
9.1 Don't post: home addresses, private schedules, school dismissal details, passwords, financial or government ID information, or private contact details of a minor; content that is unlawful, harassing, hateful, sexual, violent or defamatory; content you don't have the rights to, including commercial music; or another person's private information without permission.
9.2 We may hold, restrict, change the visibility of, or remove content or pages that raise safety, privacy, legal or rights concerns, and we may suspend accounts that break these rules.
10. Payments, cancellation and refunds
10.1 Payments are processed by Stripe. Prices are in US dollars.
10.2 You can get a full refund if you ask before your page is first published. After first publication, purchases are generally non-refundable because the service has been delivered, except for duplicate or unauthorized charges, our inability to provide the service, or where the law requires a refund. See the Refund + Cancellation Policy.
10.3 A refund, chargeback or reversed payment may unpublish or archive the related page.
11. Hosting, renewal and expiration
11.1 Hosting renewal is optional: $20 for each additional year. It is never automatic. We may send reminders.
11.2 When hosting ends, a grace period of up to 30 days may apply before the page goes offline. Renewing during the grace period keeps the same link and QR code. For 90 days after the grace period, renewing can restore the page at the same link; after that, the page's content may be permanently deleted.
12. Takedown, deletion and requests from others
12.1 You can take your page offline or request deletion from your dashboard. Taking a page offline removes public access promptly. Permanent deletion may take extra time and may not immediately remove records we must keep or temporary backups.
12.2 A featured person, a minor's parent or guardian, or a deceased person's family can ask us to review a page at [email protected]. We may take the page down while we review.
12.3 Copyright concerns: see the Copyright + Takedown Notice.
13. Service availability and changes
ProudSpot relies on third-party infrastructure and can't guarantee uninterrupted availability. We'll make reasonable efforts to restore service after outages and keep approved content for the hosting period. We may update the service and these terms. Material changes apply going forward, and we'll post the new effective date.
14. Disclaimers and limits of liability
ProudSpot is provided "as is" and "as available." To the fullest extent the law allows, we disclaim implied warranties, and our total liability for any claim related to ProudSpot is limited to the amount you paid us for the affected ProudSpot in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights that can't legally be waived.
15. Disputes and governing law
These terms are governed by the laws of the State of Georgia. If you have a concern, contact [email protected] first; we'll try to resolve it informally within 30 days. If we can't, either of us may bring a claim in the state or federal courts serving Liberty County, Georgia, or in small-claims court where you live if it qualifies.
16. Organization referrals
ProudSpot may pay participating organizations for qualifying referrals. Referral partners get no access to or control over any ProudSpot and must disclose their compensation. See the Partner Terms.
17. Contact
Use the support controls in your dashboard, reply to any ProudSpot email, or write to [email protected].
